Open Court Etiquette

  1. Be present in the courtroom before 9.00am or at any time fixed by the court.
  2. Rise and bow when the Judge/Magistrate enters and leaves the courtroom.
  3. Come forward when your name is called upon by the interpreter.
  4. Give your full attention during the proceedings.
  5. Be silent during the proceedings.
  6. Bow every time you enter and leave the courtroom during the proceedings.
  7. No children are allowed in the courtroom unless instructed to do so by the court.
  8. No weapons are allowed.
  9. No recordings either audio or visual are allowed.
  10. Mobile phones, pagers and other electronic devices are to be switched off.

Dressing Etiquette

  1. Dress decently and appropriately. You are not allowed to wear:
  2. Short pants / mini skirts
  3. Jeans
  4. Slippers
  5. Helmet
  6. Sun glasses
  7. Informal jackets such as leather, denim and others
  8. Bright colours clothing full with jewelry

 

Documents Required

  1. Self Identification
    • If you are a Malaysian citizen, you are required to bring your National Identity Card (MyKad) / birth certificate. If you are a foreign citizen you are required to bring your International passport or related documents.
  2. Government Officers
    • Bring your authority cards and/or relevant documents.
  3. Company Owner
    • Present Company's Registration Certificate and relevant documents.
  4. Company Representative
    • Present the authorization letter.
  5. Property Owner
    • Please provide grants and related documents
  6. Medical Certificate
    • If you are unable to attend court for any reasons, please inform the court promptly in writing. If you are sick, please forward your medical certificate to the court.

 

ROLE AND RESPONSIBILITIES OF WITNESSES IN COURT

A witness is someone who testifies in a cause, or give evidence under oath in a court of law. A person who has been served with a subpoena, must appear and testify in court. Failure to appear will cause a warrant of arrest to be issued.The purpose of a witness presence is to present evidence orally or in documented forms with regard to a fact so that the Court can make it decisions.WHAT YOU SHOULD DO BEFORE GOING THE COURT

Make sure the date / time and place of the hearing (Please refer to the subpoena).If you are required to produce any documents please have them ready and bring along on the day of the trial.Plan your trip so that you could reach the court before 9.00 am.

Dress decently and appropriately.

 

RESPONSIBILITIES OF WITNESSES WHEN TESTIFYING AND GIVING EVIDENCE IN COURT

Use simple language in court. Inform the court if the assistance of an interpreter is required.

Take oath in witnesses stand/box with a loud and clear as while lifted your right hand at shoulder. Produce your identity card / authority card / passport through the interpreter for Court reference and record.

Listen carefully to the questions by Prosecutor / Attorney and answer only what is asked. If there is any question that is not clearly understood, seek clarification.

Make sure that the answers / information given is honest and true. The witness is under oath to speak the truth.Bring the documents that will be produced to the court together to the witness stand/box. Get the consent of theCourt if you wish to refer to the document.

If the witness is unable to complete his evidence, the court will give another hearing date to enable the witness to complete his/her evidence.

 

  1. Who can be a bailor?
    • Malaysian citizen aged 21 years old and above.
  2. What do I need to have to use eJamin?
    • You need to have a registered online banking account with any local bank.

Do I have to use my personal bank account?

  • Yes, the registered account holder’s name must be under the same as the bailor’s.
  1. What is the maximum amount for every transaction allowed under eJamin?
    • RM30,000
  2. Do I have to pay any admin charges/fees for using eJamin?
    • No admin charges/fees will be charged for any transaction.
  3. How do I use the eJamin service?
    • You can visit the eJamin’s portal at ejamin.my from your mobile devices.
  4. How do I fill in information in the eJamin?
    • For NRIC column, do not key in (-)
    • For case number, kindly ask from the court staff and fill in all the details.
    • For home address, key in your current address.
    • For mobile phone number, do not key in (-) and country code.
  5. Can there be more than one (1) bailor for each case?
    1. Court will give order as to how many bailors is required in any case and you can still use eJamin.
    2. (For example: Bail amount is RM6,000 with two (2) bailors)
    3. Key in the total bail amount i.e. RM6,000.
    4. At the bail amount section, the first and second bailors can fill in the desired amount to be paid and make sure the amount is inserted correctly.
      • (Kindly ensure that payment is made from the bailor’s individual account)
  6. Can the system be used to post bails for 2 or more accused in one case by different bailors?
    • Yes, you can still use the system.
    • (For example: Bail is granted to two (2) accused with two sureties in one case with different amount, RM2,000 (for accused 1) and RM3,000 (for accused 2).
    • Bailor A can post a bail for the first accused and bailor B can post a bail for the second accused.
    • Bailors will have to key in a specific code B1 or B2 referring to Accused 1 or Accused 2.
    • (Example: Case No: AL-83-170-08/2020B1 for accused 1, AL-83-170-08/2020B2 for accused 2)
